Right of Withdrawal (EU Consumers)
If you are a consumer in the European Union, you may have the right to withdraw from a distance purchase within 14 days of receiving the goods without giving any reason, in accordance with applicable EU consumer protection law.
Cancellation Before Production Starts
You may request cancellation free of charge until production has started. Submitting a cancellation request does not mean that cancellation is automatically approved. We will confirm whether cancellation is still possible based on the production status of your order and applicable law.
If you need to cancel your order, contact us immediately at i@decorua.com with your order number. We cannot guarantee cancellation once production has started.
If production has already started at the time of your cancellation request, only the shipping cost may be refunded. The product cost is non-refundable where the product has already been made to your personal specifications and cannot be restocked or resold.
Products Excluded from the Right of Withdrawal
The right of withdrawal does not apply where an applicable legal exception applies, including the following categories:
- Personalised and made-to-order products — goods made to your specifications or clearly personalised. This includes products made with custom text, name, age, date, photograph, customer-specific design, custom dimensions, or other characteristics requested specifically for your order. Choosing a standard size, material, or colour offered as a normal product option does not by itself necessarily make an otherwise standard product personalised.
- Edible and perishable goods — food-grade edible decorations (wafer paper, sugar sheets, chocotransfer prints) that can deteriorate or expire and cannot be resold after production.
- Digital content delivered online — digital downloads, printable files, and Canva templates, where you have given consent to immediate delivery and acknowledged the loss of the right of withdrawal before download or access.
Final Sale Collections
The following product collections are marked as Final Sale because many products within them are personalised, made to specification, edible, digital, or otherwise fall within an applicable legal exception to change-of-mind withdrawal:
- Acrylic Cake Toppers
- Button Badges
- Cake Toppers
- Cookie Cutters
- Custom Snack Bags
- Digital Templates
- Edible Cake Toppers
- Edible Cupcake Toppers
- Party Accessories
Where a specific product falls within an applicable legal exception, it remains non-returnable for change-of-mind purposes. The Final Sale collection label itself does not remove any mandatory consumer rights that apply to a standard, non-personalised physical product.
In practice, the large majority of Decorua products fall under one or more of the exceptions above. If you are unsure whether your specific order is eligible for withdrawal, please contact us before returning the item.
How to Exercise the Right of Withdrawal (Where Applicable)
To exercise your right of withdrawal for an eligible product, send a clear statement to i@decorua.com before the withdrawal period expires.
Please include the following information to help us identify and process your request:
- Your full name
- Your email address used at checkout
- Your order number
- Date of order and date of delivery
- A clear statement that you wish to withdraw from the contract
We will not reject an otherwise valid withdrawal solely because a non-essential detail is missing, provided that the order and withdrawal request can be reasonably identified.
We will confirm receipt by email without undue delay.
Refund After Withdrawal
For an eligible withdrawal, we will reimburse the payments received for the eligible goods, including the cost of our standard outbound delivery method. If you selected a more expensive express, priority, or upgraded delivery option, any additional amount above the cost of standard delivery is not refundable.
Return shipping costs are at the customer's expense unless otherwise required by applicable law.
We may withhold reimbursement until we have received the returned goods, or until you have supplied evidence that the goods have been sent back, whichever is earlier.
Returned goods should be sent back in original condition to receive a full refund. If handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods reduces their value, we may make any deduction permitted by applicable law.
Refunds are made using the same payment method used for the original transaction unless you expressly agree otherwise.
For full details, see our Right of Withdrawal page and our Refund Policy.
Alternative Dispute Resolution (Czech ČOI ADR)
If a consumer dispute arising from a purchase contract or service contract cannot be resolved directly with us, the consumer may submit a proposal for out-of-court resolution to the competent ADR body:
Česká obchodní inspekce
Ústřední inspektorát – oddělení ADR
Gorazdova 1969/24
120 00 Praha 2
Email: adr@coi.gov.cz
Website:
https://coi.gov.cz/informace-o-adr/
ADR before ČOI is intended to help the parties reach an amicable settlement. ČOI does not replace the courts and does not issue a binding decision on the dispute in the same way as a court.
Governing Law
This Legal Notice and transactions with Decorua are governed by the laws of the Czech Republic, without prejudice to mandatory consumer protections that apply under EU law or other applicable law. Jurisdiction is determined by applicable law.
